Terms and conditions of our service.

Please note our U sell services are all subject to Vat.  Our agreement is for a 12 month period from the receipt of initial payment.  Your property will be withdrawn from sale once a sale has legally completed.  If the property is unsold after 12 months we will withdraw from sale unless you pay our fee for the service required, as quoted above, to renew the contract for a further 12 month period.

Cancellation of Contracts Made in a Consumers Home or Place of Work Regulations 2008

This Notice has been provided to you because you have entered into a contract to which the Cancellation of Contracts made in a Consumer's Home or Place of Work Regulations 2008 ('the Regulations') apply. The contract is for the supply to you of goods or services. The person providing the goods or services is referred to in the Regulations as 'the trader'.

Under the Regulations, you have the right to cancel this contract if you wish to do so. In order to exercise your right to cancel the contract, you need to deliver or send a cancellation notice, that is, a written notice that you wish to cancel the contract. You can send your notification by email if you prefer.

Any cancellation notice should be delivered or sent to the Residential Lettings Department at Antony Hill Group 11 Hoghton Street Southport PR9 0NS or at lettings@ahgroup.net.

You have 7 days in which to serve a cancellation notice. The period of 7 days begins with the date when you receive this Notice. This 7 day period is referred to in the Regulations as 'the cancellation period'.

Under the Regulations, a cancellation notice is treated as being served as soon as it is sent or posted to the trader. A cancellation notice sent by electronic communication is treated as being served from the day when it is sent to the trader.

Data Protection

The Agent is registered under the Data Protection Act 1998

Rules of Conduct

The Agent is a member of the NAEA and OEA and has agreed to abide by their Rules of Conduct and Code of Practice.

Money Laundering

Under the Money Laundering Regulations 2003 and The Proceeds of Crime Act 2002 the Agent is legally obliged to verify the identity of the Client through sight of legally recognised photographic identification (e.g. passport, photographic drivers license) and documentary proof of address.

Ombudsman for Estate Agents

The Agent is a member of the OEA (Ombudsman for Estate Agents) and follows the OEA Code of Practice. The Client agrees that the Agent may give information about the sale of the Client’s property to the Ombudsman, if the Client has registered a complaint and they ask for that information. The Client also agrees that the Agent may give the Client’s contact details to OEA Ltd (if they ask for it) to help them monitor how the Agent is following the Code of Practice.

energy performance certificates

In accordance with the Housing Act 2004, an Energy Performance Certificate (EPC) must be provided before the commencement of marketing. By signing this agreement the Client has agreed to the provision of an EPC for the property and the agent will instruct a provider to contact the client and arrange for a EPC to be prepared. The client will be responsible for the cost of the EPC and will discuss the funding options directly with the provider.

An EPC is included in our comprehensive package.

U-Sell options

Value package is charged at £395.00 plus Vat. Total £474.00

Comprehensive package is £665.00 plus Vat. Total £798.00

Settlement of fees

(a) Fees can be paid in full in advance of the marketing of your property or

(b) Fees can be paid by equal monthly payments via standing order over a maximum ofa six month period

For Sale Boards

The Agent asks permission to erect a For Sale board at the Property to assist in the marketing of the Property. Any such board will comply with the Town and Country Planning (Control of Advertisements) Regulations 1992 as amended.

The Agent accepts liability for any claim arising under these Regulations in connection with the board, unless the action arises as a result of a further board being erected by another agent. The For Sale board will remain at all times the property of the Agent.

Offers and viewings

When our value package is selected your nominated contact telephone number or e mail address will be given to potential viewers who will thereafter deal with you directly regarding the sale.

When our Comprehensive package is selected we will arrange all viewings directly with yourself and obtain feedback thereafter.  All offers will be reported verbally and via e mail.  A written or computerised record of all offers received will be kept (including the date and time such offers were received by U-Sell  and the client’s response).

This record will be available to the Client on request. In turn, the Client must promptly inform the Agent of all enquiries or discussions which the Client may have with any prospective purchaser which are not made via the Agent

Extra services

By law, the Agent must tell the Client if the Agent or any connected person intends to earn any commission from offering the Client or a buyer other services. If the Agent or any connected person earns money from any of these services the Agent or connected person would keep this commission. The following services will be offered by U-Sell  or connected persons:

The Client’s property details

The property details will be prepared by ourselves it is very important that the Client reads these details carefully and lets U-Sell know if there is anything that the Client thinks should have been included or that is wrong.

Discrimination

The Agent will not discriminate against any person under the definitions of The Sex Discrimination Act 1975, The Race Relations Act 1976 or the Equality Act 2006. The Agent will not discriminate, or threaten to discriminate against any prospective Buyer of the Client’s property because that person is, will not be, or is unlikely to be accepting services that the Agent will (directly or indirectly) provide.
